Terms & Conditions
Payments
Orba Travel Brokers (Orba) will accept, via telephone or via our
online booking tools (covering Insurance, Air, Accommodations, Car Hire,
Transfers and/or Sightseeing Tours via such tool), payments by Credit Card or by
mail, a cheque, where at least 7 days ‘clearance time’ is available for
cheques. Please note that payments by cheque may not be applicable when
affecting many bookings due to provider-applied rules and regulations. This is
especially the case in the instance of making certain types of air bookings via
the Online Air Booking tool available as a link on www.orba.com.au.
Full payment for travel arrangements made via our booking engine is
due at the same time as making the booking. Only in certain instances can
payment for International be made after the online booking process is
completed.
Credit
Card Payments
Orba Travel Brokers will levy a credit card administration/service
fee for credit card payments. These charges are between 1.5% and 3.5%
(dependent on type of credit card used). These charges will appear on the Review
page of the on-line booking process. Credit Card payments need to be made at
the same time as finalising your bookings online. In certain instances you may
be required to provide credit card verification in writing before a payment can
be processed.
Ticketing
For International and domestic departures e-tickets will be
issued upon payment and completion of the booking process. New
regulations effective from 01 June 2008 mean that most airlines will
no longer be able to issue paper tickets. In some instances Orba
may not be able to issue an e-ticket on the flights and
fare selected. Bookings that can not be issued as an e-ticket will
have to be changed to comply with e-ticket regulations; a consultant from
Orba will contact you to advise alternate options.
Some types of airline tickets require and are of an “instant purchase” type. In
the event you book one of these, accept the terms and conditions that are
specific to the issuance of this type of ticket and provide suitable credit
card details, Orba Travel Brokers will endeavour to issue said ticket. Until an
e-ticket or notice of successful ticket issuance has been received by the
passenger, it is deemed that the purchase has not been successfully transacted.
Amendments
and Cancellation Fees
We reserve the right to charge a minimum amendment fee of AUD$55
per person on International departures for each change to a confirmation of
booking. This is in addition to any fees charged by the travel provider. The
minimum charge for Domestic booking amendment is also $55. These fares are in
addition to any increase in fare and taxes.
Virgin Blue or Jetstar passengers requiring amendments or changes must
contact the carrier/s direct.
We also reserve the right to charge a minimum cancellation fee of
AUD $110 per person for International departures which will be in addition to
any charges made by the travel provider, which in some cases can be the loss of the full amount you have paid.
Refunds of monies will take a minimum of 16 weeks to obtain from
the actual airlines and/or travel providers.
It is important to note that name changes are often regarded by
travel providers as a FULL CANCELLATION and as
such these changes will incur full cancellation charges.
All travel providers charge amendment and cancellation fees.
Validity
of Prices
Prices on the Orba Travel Brokers web site, links to/from the Orba
Travel Brokers website and other providers/insurance companies and as featured
in any booking engine accessed via the Orba Travel Brokers website are subject
to availability and conditions. They are
also subject to change without notice. Fares cannot be guaranteed until paid in
full and documents have been issued.
Prices
Do Not Include
Items of a personal nature, such as telephone calls, alcoholic
beverages, gratuities, etc.
Responsibilities
Except to the extent that the law imposes a non-excludable
liability:
a.
All bookings for products on the Orba Travel Brokers website or
found on provider’s pages as accessed through or via links on the Orba Travel
Brokers website are accepted subject to the conditions of carriage and other
conditions imposed by suppliers and subcontractors to Orba Travel Brokers.
b.
Orba Travel Brokers cannot guarantee or warrant the standard, class
or fitness for purpose of any product or service mentioned;
Orba Travel Brokers has used information supplied to it by the
operators of the relevant services in the development of this website. We have endeavoured
to ensure that the information contained on the web site is correct but clients
should not rely, and are not invited to rely on the accuracy or validity of any
information on the web site as the basis for any action, refraining from acting
or disbursement and Orba Travel Brokers expressly disclaims any liability for
any loss or damage incurred by clients arising out of any such acts or omission
or disbursements.
Orba Travel Brokers disclaims and will be exempt from any liability
under the law of contract, tort or by virtue of statutory enactment in relation
to any-
a.
loss to;
b.
personal injury death or illness of;
c.
damage or theft of personal property of any sort of;
d.
expense of inconvenience caused through delay to;
e.
disappointed expectation of;
f.
accident befalling;
the traveller or any dependents, arising out of any negligent act
or omission, breach of any duty imposed by statute, breach of any law of the
place of destination or on route to or from the destination, tort (whether
intentional or unintentional), or breach of a contractual term, whether
expressed or implied or breach of duty arising under or imposed by any law on
the part of Orba Travel Brokers, providers/suppliers and or anyone acting on
behalf of or as agents for services and or products on our website.
Choice
of Law
You agree with Orba Travel Brokers (Orba) that in so far as any
contractual relationship is created between you and Orba by you making a
booking through Orba, then that contract is subject to the laws of Western
Australia.
Jurisdiction
You agree to submit to the jurisdiction of the courts of Western
Australia for the determination of any dispute and the making of any claim
against Orba and acknowledge and agree that a court having jurisdiction in
respect of the dispute or claim is the appropriate court.
Passports
& Visas
Visas are passengers own responsibility. More information can be
found at:
www.dfat.gov.au or www.smartraveller.gov.au
Please check with the respective Embassy or Consulate of each
country that you are scheduled to visit as many destinations require visas for
both Australian and Non-Australian Passport holders.
Please ensure you have at least 6 months validity on your passport AFTER
your return date and that your first name and surname as displayed on your air
ticket are exactly the same as it appearing on your passport.
Departure
Times and Flight Numbers
Most airlines state that there is no need to re-confirm your
departure times and flight numbers. Nonetheless, Orba Travel Brokers will
not take responsibility for any flight time or flight number alteration made by
airlines. We strongly advise that all flights should be re-confirmed by phone
with the relevant airline at least 72 hours prior to departure for each
individual flight. At this time please take the time to reconfirm any special
requirements/needs/seating as booked or requested for onwards travel.
Frequent
Flyers
If you are a member of an airline's frequent flyer scheme, please
ensure that you have entered your correct number in the special section
featured in the booking engine at the time of your booking. We will not take
responsibility if the airlines do not register your trip. You are advised to
retain copies of your air ticket and boarding pass.
Special
Requests
Special requests will be always passed on to the travel providers
but can never be guaranteed.
